These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", "your") and EC Rent Limited ("EC Rent", "we", "us", "our"), a company incorporated in Hong Kong, governing your use of the EC Rent website (ecrent.com.hk) and all services provided through it, including but not limited to equipment rental, delivery, collection and related services.
By accessing this website, placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using our website and services.
1. Eligibility and Account
1.1. You must be at least 18 years of age and possess full legal capacity to enter into binding agreements under the laws of the Hong Kong Special Administrative Region to use our services.
1.2. By placing an order, you represent and warrant that the information you provide is accurate, complete and current. You agree to promptly update any information that becomes inaccurate.
1.3. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
2. Service Description
2.1. EC Rent provides home care and medical support equipment on a rental basis. Our services include equipment delivery, setup (where applicable), collection upon rental termination, and customer support during the rental period.
2.2. All products displayed on the website are subject to availability. We reserve the right to modify, discontinue, or update product listings, descriptions, pricing, and availability at any time without prior notice.
2.3. Product images are for illustrative purposes. While we endeavour to display accurate representations, the actual equipment may differ slightly in appearance from website images due to model variations, updates or photography conditions.
3. Orders and Pricing
3.1. An order is not confirmed until we have verified stock availability and acknowledged receipt. We reserve the right to reject any order at our sole discretion, including but not limited to cases of suspected fraud, payment issues, or unavailability of stock.
3.2. Prices displayed on the website are in Hong Kong Dollars (HKD) and include rental fees as quoted but exclude deposits, delivery fees (where applicable), and any consumable items unless expressly stated.
3.3. Monthly rental fees are calculated on a per-calendar-month basis. Partial months are charged as full months unless otherwise agreed in writing.
3.4. We reserve the right to amend pricing at any time. Pricing changes will not affect confirmed orders already in progress.
4. Deposits
4.1. A security deposit is required for all equipment rentals. The deposit amount is specified at the time of order and varies by equipment type and value.
4.2. The deposit will be refunded in full within 7 business days of equipment return, provided the equipment is returned in the same condition as when delivered (fair wear and tear excepted), and all rental fees have been paid in full.
4.3. EC Rent reserves the right to deduct from the deposit any costs arising from damage to, loss of, or unreasonable deterioration of the equipment beyond normal wear and tear, including but not limited to repair costs, replacement parts, cleaning fees, or the full replacement value if the equipment is lost or damaged beyond repair.
4.4. If deductions are made from the deposit, we will provide an itemised statement of deductions.
5. Rental Period, Renewal and Termination
5.1. The rental period commences on the date of delivery and continues for the minimum term selected at the time of order.
5.2. After the minimum term, the rental automatically renews on a monthly basis at the applicable monthly rate unless terminated by either party.
5.3. To terminate a rental, you must notify us at least 3 business days before your desired collection date. Collection will be arranged at a mutually agreed time.
5.4. Early termination during the minimum rental period does not entitle the customer to a refund of rental fees already paid for the committed term.
6. Delivery and Collection
6.1. Delivery is provided free of charge to most locations within Hong Kong. Certain remote locations or special delivery requirements may incur additional charges, which will be communicated before order confirmation.
6.2. We will endeavour to deliver within the estimated timeframe communicated at the time of order, but delivery dates are estimates only and not guaranteed. EC Rent is not liable for delays caused by circumstances beyond our reasonable control.
6.3. You are responsible for ensuring adequate access to the delivery location (including lift access, doorway clearance, and suitable space for equipment). If delivery cannot be completed due to access issues, re-delivery charges may apply.
6.4. Upon delivery, you must inspect the equipment and report any defects or discrepancies within 24 hours. Equipment is deemed accepted in satisfactory condition if no report is made within this period.
6.5. Collection upon rental termination is provided free of charge. You must ensure the equipment is accessible for collection at the agreed time.
7. Customer Obligations
7.1. You agree to use the equipment only for its intended purpose, in accordance with any operating instructions provided, and in a safe and responsible manner.
7.2. You shall not modify, repair, disassemble, or alter the equipment in any way without our prior written consent.
7.3. You shall keep the equipment in a clean and hygienic condition during the rental period and shall follow any maintenance guidance provided.
7.4. You shall not sublease, lend, sell, pledge, or otherwise transfer the equipment to any third party.
7.5. You must notify us immediately of any malfunction, damage, loss, or theft of the equipment.
7.6. Equipment remains the property of EC Rent at all times. The rental agreement does not transfer ownership to the customer.
8. Equipment Condition and Hygiene
8.1. All equipment undergoes professional cleaning and sanitisation before each rental. We adhere to strict hygiene protocols appropriate to the equipment category.
8.2. While we take all reasonable precautions, EC Rent does not warrant that equipment is free from all microorganisms or allergens. Customers with specific health vulnerabilities should take additional personal precautions as appropriate.
9. Liability and Disclaimer
9.1. EC Rent's liability under or in connection with these Terms, whether in contract, tort (including negligence), misrepresentation, restitution or otherwise, shall be limited to the total rental fees paid by you during the rental period in question.
9.2. EC Rent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of business, personal injury, or any other losses arising from the use of or inability to use the equipment, even if we have been advised of the possibility of such damages.
9.3. EC Rent provides equipment for rental purposes only and does not provide medical advice. Customers are responsible for consulting qualified healthcare professionals regarding the suitability and proper use of any medical or care equipment.
9.4. Nothing in these Terms shall limit or exclude liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
10. Force Majeure
10.1. EC Rent shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to typhoons, floods, earthquakes, epidemics, pandemics, government actions, civil unrest, strikes, power failures, internet failures, or supply chain disruptions.
11. Intellectual Property
11.1. All content on this website, including but not limited to text, images, logos, designs, software, graphics, and trademarks, is the property of EC Rent or its licensors and is protected by copyright, trademark, and other intellectual property laws of Hong Kong and international conventions.
11.2. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website without our prior written consent.
12. Governing Law and Dispute Resolution
12.1. These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
12.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
12.3. Prior to commencing any legal proceedings, the parties agree to attempt to resolve disputes through good faith negotiation for a period of not less than 14 days.
13. Amendments
13.1. We reserve the right to modify these Terms at any time. Material changes will be notified via the website. Your continued use of our services after any modification constitutes acceptance of the modified Terms.
